Troy King’s Office Screws Up Again
0
Yet another example of the fine work of the Attorney General’s office.
A judge Tuesday dismissed a 56-count indictment against Bessemer Circuit Judge Dan King because the indictment was not presented in open court as required by state law and the guidelines set out in Alabama Rules of Criminal Procedure.
King, who has been on the bench since 1997, said he is ready to return to work.
“I knew that with the great lawyers I had, and with the facts and the law on my side, that justice would be done,” King said. “I’m ready to go back to work and serve the people. I’m sorry it’s taking so long for me to get back.”
…
Of the 312 indictments returned in the April grand jury session, Judge King’s indictment was the only one not presented in open court, according to testimony.
Why? The AG is going to claim this was a “technicality”, but this was a hole in the case big enough to drive a truck through, and it costs taxpayers money. He certainly shouldn’t give up on the prosecution, but do it the right way next time.
